Terms and Conditions for Using the VSD Decision Tool Prototype

These Terms and Conditions set out the rules for using the VSD Decision Tool prototype, made available by Rozwój&Dotacje Aleksandra Wolniak.

1. Service Provider

Hereinafter in these Terms and Conditions, this entity is referred to as the “Service Provider”.

2. Nature of the prototype

The application is a research and experimental prototype. It has been developed to test a solution that uses artificial intelligence to analyse user responses and generate recommendations.

The application may be used for validation research and the preparation of a master’s thesis.

The application is not a final commercial product. Its functions, content, mode of operation, scope of availability and the quality of the recommendations generated are subject to change.

3. Purpose of the application

The purpose of the application is:

  • to collect responses regarding projects;
  • to analyse responses using an AI language model;
  • to generate recommendations of a supportive nature;
  • to evaluate the prototype’s performance;
  • to collect material for the validation of the solution and the preparation of a master’s thesis.

4. Terms of use

Use of the application is voluntary.

The user may use the application by providing fictitious, test, sample or anonymised data.

The user undertakes to use the application in accordance with its intended purpose, the law, good practice and these Terms and Conditions.

5. Prohibition on providing certain information

The user should not enter the following into the application:

  • personal data, unless necessary;
  • special categories of data, in particular data concerning health, political opinions, religious beliefs, trade union membership, sexual orientation, biometric or genetic data;
  • data concerning criminal convictions or offences;
  • data relating to customers, employees, colleagues or other third parties;
  • confidential information;
  • trade secrets;
  • information subject to professional secrecy;
  • information which the user does not wish to provide to an external AI model.

The Service Provider recommends the use of fictitious, test, sample or anonymised data.

6. Use of AI

The application uses an AI language model provided by OpenAI.

The user’s responses may be analysed using the AI model to generate recommendations.

The user acknowledges that AI systems may generate responses that are incomplete, incorrect, out of date, imprecise or unsuitable for the user’s specific situation.

7. Nature of recommendations

Recommendations generated by the application are for auxiliary, informational, research and experimental purposes only.

Recommendations do not constitute:

  • legal advice;
  • tax advice;
  • financial advice;
  • medical advice;
  • psychological advice;
  • professional expertise;
  • a binding project assessment;
  • an administrative, business or investment decision;
  • a guarantee of obtaining financing, a subsidy, a grant or any other outcome.

The user should independently verify the recommendations before using them or consult a relevant specialist.

8. No decisions regarding the user

The application does not make decisions regarding the user that have legal consequences or similarly significant impact on them.

Recommendations generated by the application do not determine the user’s rights, obligations, or legal, financial, professional or business situation.

9. Use of responses for research purposes

The user’s responses may be used to validate the prototype and prepare a master’s thesis.

The results of the study will be presented in anonymised or aggregated form, without identifying specific users.

The Service Provider does not intend to publish individual responses in a manner that would allow the identification of the user or any other natural person.

10. Availability of the prototype

The Service Provider may at any time modify, restrict, suspend or terminate the operation of the application, in particular for technical, organisational, research, security or legal reasons.

The Service Provider does not guarantee uninterrupted availability of the application or the error-free operation of all functions.

11. Technical limitations and security

The following is prohibited:

  • attempting unauthorised access to the application, server, database or technical infrastructure;
  • testing the application’s security without the Service Provider’s prior consent;
  • circumventing security mechanisms;
  • attempting to manipulate the operation of the AI model, in particular through instructions designed to circumvent the application’s operating principles;
  • entering content that is unlawful, harmful, infringes the rights of third parties or may disrupt the operation of the application;
  • using the application for activities contrary to the law or public decency.

12. User liability

The user is responsible for the content of the information entered into the application and for the manner in which the generated recommendations are used.

The user should ensure that the information entered into the application does not infringe the rights of third parties, obligations of confidentiality, trade secrets, professional secrecy or the provisions of law.

13. Service Provider’s Liability

The application is made available as a research prototype.

The Service Provider does not guarantee that the recommendations generated by the application will be correct, complete, up-to-date, useful or suitable for the user’s specific purpose.

To the extent permitted by law, the Service Provider shall not be liable for any decisions, actions or omissions of the user taken on the basis of recommendations generated by the application.

The above provisions do not limit the Service Provider’s liability to the extent that such a limitation would be impermissible under mandatory provisions of law.

14. Personal data and cookies

The rules governing data processing in connection with the use of the application are set out in the Privacy Policy.

The rules governing the use of cookies and similar technologies are set out in the Cookie Policy.

15. Amendments to the Terms and Conditions

The Service Provider may amend the Terms and Conditions in connection with the development of the application, changes to its operation, changes to technology providers, changes to the scope of the survey, or changes to the law.

The current version of the Terms and Conditions will be available within the application.
